    Keep your receipt and, within 15 days following payment, file a complaint to the agency where you are required to appear. If confirmed by investigation, the overpaid fine will be returned.

  • Do I need to pay land value increment tax on the purchased price through negotiation?

    According to Article 11 of Land Expropriation Act, the purchased price through negotiation in market price shall comply with the provision of Article 42-3 in The Equalization of Land Rights Act, that those who voluntarily sell lands to the land acquisition authority in the compensation price for expropriation will be waived from land value increment tax.

  • How can I apply for compensation on private roads already exist?

    Private roads already exist are lands that have been used for a long time and are public facilities. In terms of the handing of private roads already exist, there are a lot of similar roads in the provincial highways system under our authority and a huge budget of expropriation will be required; it is not a budget that the government can afford. Therefore, we follow “Guidelines for Land Acquisition of Private Roads Already Exist Under the Provincial Highways Managed by Highway Bureau, MOTC” to deal with the private roads already exist. The main method of acquisition is through the consolidation into annual engineering projects.

  • How can I deal with suspension of use or hand in for cancellation if my vehicle is not in use for any reason?

    Required documents:
    1. Original copy of vehicle owner’s national I.D. card (or military services I.D. card or alien residence permit) (in individual’s name); official letters issued by the competent authority for the approval of the company’s or establishment’s registration (please enclose registration form if it is a company) or registration certificate issued by the competent authority for the company’s or the establishment’s and seal (in the company’s name).
    2. Vehicle registration certificate.
    3. Two license plates.

    1. Companies and establishments that submit photocopies of above documents for verification must provide a copy of the latest business tax payment certificate.
    2. Please pay off any outstanding penalty for violation first as well as overdue vehicle license tax and fuel tax (please enclose payment receipt if it has been paid within the past two months).
    3. Suspension of use shall not exceed one year, and please apply for license plate revocation when overdue.
    4. If the date of periodic inspection is overdue when applying for suspension of use, an overdue penalty of NT$900 will be imposed.
    5. If the vehicle for hand in cancellation is registered with movable property as a guarantee, please deal with the revocation registration of the movable property as a guarantee first.

  • What is the standard of land value compensation on the land expropriated?

    According to Article 30 of Land Expropriation Act, the value of expropriated land shall be compensated based on its current market value. The value of land reserved for public facilities in the urban planning area shall be compensated based on the average market value of its adjoining lands not reserved for public facilities. The market value referred to in the preceding paragraph shall be forwarded by the municipal or county (city) competent authority to the Land Value Evaluation Committee for determination. Municipal or county (city) competent authorities should constantly survey the market values within their jurisdiction and ask its Land Value Evaluation Committee to determine the extent of change in the market values of expropriated lands once every six months as basis for adjusting the compensation for expropriation.

  • How is the purchased price through negotiation on the land determined?

    In terms of the purchased price through negotiation, according to Article 11 of
    Land Expropriation Act, the purchased price shall be negotiated with the owner in market price. In addition, according to the official letter published by Ministry of the Interior, the so-called market price refers to the normal transaction price. The information of the market price shall be referred to the public information disclosed by the government or the relevant information provided by real estate agency industry or the investigation done by a real estate appraiser.

    The market price we used for acquisition agreement is determined after comprehensively evaluating and analyzing the relevant public information disclosed by the government and the market price provided by local Department of Land or local Land Office or the investigation done by a real estate appraiser.

  • What kind of condition is applicable for applicants to require oral test replacing written exam during the automobile (motorcycle) driving license test?

    Written exam can be replaced with oral test. If the applicants are deaf-mutes, sign language can be used instead.

  • Why is Suhua Highway a general provincial highway but does not allow motorcycles to access?

    The total length of Suhua Highway Improvement Project is 38.8 kilometers. Although it is a general provincial highway, there are 8 tunnels, with a length 24.5 kilometers in total, and it accounts for 63% of the whole highway. Among them, there are 4 tunnels with a length of 3 kilometers or more, and it accounts for 53% of the whole highway. Guanyin Tunnel and Gufeng Tunnel are connecting to each other, and the total length of the two tunnels is 12.6 kilometers. Compared with general provincial highway, Suhua Highway Improvement Project consist various tunnels. On top of that, it opens to large truck, making the types of vehicles using the highway a lot more complicated than Xueshan Tunnel on National Freeway No. 5. Considering there is only one lane, the most important topic when Suhua Highway Improvement Project is underway is the road safety in tunnels.
    With the condition of only one lane on both traffic direction on Suhua Highway Improvement Project, as well as the consideration of ventilation, temperature, Suhua corridor accident prevention, vitalization and development of the existing settlement on Suhua Highway, and transportation flow of passenger and cargo vehicles, it is planned at the design stage that the types of vehicles can use Suhua Highway Improvement Project are small vehicles, large passenger vehicles, large trucks (including semi-trailers). In terms of motorcycles, due to the ratio of large truck in the total vehicle types on Suhua corridor (around 15% on March 9th, 2020 (Monday)) as well as the light and road environment in the closed environment of tunnel over 3 kilometers are not as good as that on general road, we take into account the high risk of motorcycles mixed in the traffic flow with large vehicles on the single lane in the long tunnel and motorcycles are relatively vulnerable in protection measures among carriers. Therefore, the conclusion is that no motorcycles shall be allowed on Suhua Highway Improvement Project, except for the section of “Hejen to Dachingshui”.

  • How will you handle the houses and lands under your management occupied by private persons?

    It will be handled as below if any situation of occupation is found.
    1. Coordinating with the occupier to return the property in its original state.
    2. If there is any violation on the relevant laws or use control involved, the relevant competent authority shall be notified and shall coordinate according to legal regulations.
    3. It shall be filed for civil action to solve the issue.
    4. According to Article 320 and Article 349 of Criminal Code, it can request local police administration for investigation or directly file a lawsuit to the prosecutor's office. If the situation of occupation affects national security or public security, it shall be brought to justice in priority.
    5. Other proper handling methods for occupation removal.
